Recently, there has been a notable increase in the number of Employment Tribunal cases in the UK which specifically revolve around a Claimant’s menopause. There are many preconceptions and much misinformation regarding this topic. However, it is an issue worth understanding as women aged between 45-59 make up a significant percentage of the workforce. A recent survey has shown that 25% of women with menopausal symptoms have considered leaving the workplace.

Tribunal Tale – Indirect sex discrimination

Alice Thompson, the Claimant, worked at a London based estate agency as a sales manager. After she announced her pregnancy there were a number of incidents which in the eyes of the Claimant amounted to a pattern of hostility.  She was absent on maternity leave from October 2018 to October 2019. On her return to work, she made an unsuccessful application for flexible working, and lodged a grievance about her treatment when pregnant; on learning both had been rejected, she resigned. She claimed pregnancy and maternity discrimination, harassment related to sex, indirect sex discrimination in respect of the flexible working request, unfair dismissal, and unlawful deduction of commission payments from wages.

Navigator News – New Arrival

I am delighted to share with you news of the latest arrival to the team at Navigator. As many will know, we have a significant market share within the independent school sector in Scotland and we have continued to grow that dedicated resource which has been assembled to deliver particular services to that sector. As well as our Head of Employment Law having been the lead adviser to the largest teaching union in Scotland for eight years before joining Navigator, we also boast two of our HR Projects team having experienced life on the “inside” while being employed as HR Managers of independent schools in Scotland. As part of that continued development, Jonathan Molloy will be joining the team from 1st September.

Legal Issues – Working from home pay

The working landscape has dramatically shifted since the beginning of the COVID 19 pandemic. While some companies are comfortable with the working from home set up, others are anxious to return to the office. A topic that is proving quite controversial is the issue of pay. Some have suggested that those who will be working from home permanently should have their pay cut. An example of this in the US is that Google has launched a pay calculator which has resulted in some employees being left with a pay cut. Google’s response to this is to say that pay has always been based on location and the expense of living.
