Tribunal Tales – Mr J Kovalkovs v 2 Sisters Food Group Ltd

Mr Kovalkovs, the Claimant, was a factory worker at a chicken processing company in Dundee. His Orthodox Christian faith meant that he always wore a crucifix necklace. The company had a foreign body control policy which only permitted employees to wear a wedding band in the factory.

Last week at the ICO’s Data Protection Practitioners Conference, there was much discussion of IC025, the regulator’s recently published draft action plan for the coming three years.  Consultation is ongoing, with the finalised plan to be in operation from October 2022.

Legal Issues – Holiday Pay

The Supreme Court has now issued its long-anticipated decision in the case of The Harpur Trust v Brazel. The Court has held that a music teacher who only worked for part of the year, albeit on a year-round contract, was entitled to the same paid holiday as employees working all year, unanimously dismissing an appeal.

Tribunal Tales – Walters v Active Learning Trust

Rev Keith Walters was employed as a caretaker at the Isle of Ely primary school. In June 2019 he tweeted a post reminding Christians that they should not attend or support any Pride events as they were contrary to the Christian faith and harmful to children. He did this outside of school hours and on his own personal account.
